Managing Intake, Jurisdiction, and Dismissals Workshop

This workshop is designed for individuals who want to improve their skills at managing compassionate intake, making jurisdictional determinations, and documenting the results of an initial assessment, including any dismissals, referrals, or appeals that may arise.

Attendees will participate in small group breakout sessions where they will work through a set of brief case studies that challenge them to apply the ATIXA practices. Managing Retaliation Complaints Workshop

10:00am-2:00pm ET

Nearly all Title IX practitioners will have to respond to retaliation complaints during their careers. They’re materially different from other Title IX complaints concerning analysis and assessment of intent, and retaliation is generally more complex and challenging to address.

Counter-complaints are increasingly common, posing challenges regarding timing, appropriate charges to file, how many procedures are required, and ensuring counter-claims are not retaliatory. These difficulties are further compounded by the sophisticated multi-step analysis needed to determine whether conduct meets the retaliation standard and the distinct definition of retaliation in Title IX regulations.

This workshop is designed to provide practitioners with a deep dive into core concepts for evaluating the merits of a retaliation allegation, managing retaliation complaints amidst continuing resolution of the underlying complaint, and how to minimize the risk of cat’s paw liability. Supporting Pregnancy, Parenting, and Related Conditions Workshop

Gain a comprehensive understanding of the Title IX regulatory requirements and ATIXA’s recommended best practices for accommodating pregnant students, employees, and individuals with pregnancy-related conditions.

Participants will define pregnancy and related conditions, including non-medical childcare needs, lactation, fertility treatments/IVF, adoption, abortion, and miscarriage.

Writing Outcome Rationales Workshop

Proficiency in writing precise rationales is essential for both investigators and decision-makers during the formal grievance process. Rationales are intricate and require significant analytical and writing abilities to effectively convey the practitioner’s thoughts. This includes analyzing all relevant facts, applying policies, assessing credibility, applying the standard of proof, making a final determination, elaborating on sanctions, and providing reasons for the decision.

Applying Policy in Investigations & Determinations Workshop

Title IX team members must deeply understand the Title IX policy-based offense definitions of their district, school, or institution. This includes complex legal constructs and terms of art. Deconstructing an offense definition into its component elements (parsing) is critical to effectively serving as an investigator or decision-maker, roles that must understand the process of converting policies into models of proof.

Participants will practice breaking down policy language into critical elements and using those elements to guide their analysis. ATIXA’s expert faculty members will demonstrate how to use policy deconstruction tools to provide clear insights into the tasks required during each phase of the formal grievance process.

Making Supportive Measures Count Seminar

3:00pm-5:00pm ET

Supportive measures can be crucial for individuals contending with the aftermath of sexual violence or other conduct covered by Title IX. This workshop offers a comprehensive overview of ATIXA’s recommended best practices to support the needs of all parties involved in the Title IX process. This includes adhering to federal requirements under Title IX and the Clery Act/VAWA Section 304.

ATIXA’s faculty members will guide participants in identifying appropriate supportive measures for each party, understanding an unreasonable request, and working with the parties to ensure effective supportive measures. Participants will learn how to meaningfully coordinate with faculty/teachers and administrators and maintain records. Understanding Consent Workshop

10:00am-2:00pm ET

Understanding and analyzing consent requires an appreciation of the nuances of how consent really works.

ATIXA’s expert faculty members will lead a detailed discussion of consent, including legal and policy constructs, consent communication, implied consent/reciprocation, ratification, incapacitation, conditions on consent, and withdrawal of consent.

Attendees will participate in small group breakout sessions to apply these lessons to short case studies. Following this, participants will share their findings and consolidate their learnings into a coherent consent construct with guidance from ATIXA faculty. Click here to learn more.
