What can attendees expect to learn?

Consent can be understood superficially or deeply. This half-day workshop allows for a deep dive beyond “Yes means yes, and no means no.” Understanding consent and applying it requires an appreciation of the nuances of how consent works. The facilitators will spend the first two hours of the course in a detailed discussion of the bulleted topics below. Then, participants will work through six to eight short case studies in small breakout groups for an hour to apply the lessons of the morning discussion. For the last hour, the participants will all come back together to discuss the case studies and weave all the course learning together into a cogent consent construct.

If you can’t explain each of the topics below, this training will benefit and broaden your ability to conceptualize and apply consent standards:

  • Setting the policy frame:
    • pure consent
    • ”affirmative” consent
    • hybrid (regs-based) of consent/force/resistance
  • Default non-consent
  • Non-consent within consent?
  • Consented-to force/violence (BDSM)
  • Where/how consent can be assumed
  • How is verbal consent communicated – what does it sound like?
  • Is consent a reasonable person standard or a mutually understood standard?
  • Implied consent?
    • Is consent targeted or blanket?

  • What impacts on the voluntariness of consent?
    • Coercion, pressure, duress, fraud

  • A rational understanding of incapacity
    • Incapacity v. blackout
