What Every Title IX Administrator Needs to Know About Disparate Treatment, Single-Sex Programs, and Academic Scholarship Equity

Course description: While sexual harassment and sexual assault tend to dominate conversations about Title IX, this four-hour ATIXA workshop instead focuses on issues of sex discrimination that are critical to compliance for all Title IX offices, and that have become the subject of increasing complaints to OCR (at least 300) against colleges and universities.

Attendees will explore the topics below in an engaging format that will provide 90 minutes of teaching by an expert facilitator. Then, the audience will be placed into small groups to work on a set of case studies for 75 minutes. The workshop will end with all participants reconvening as a group for 75 minutes to discuss each case study, share solutions, problem-solving techniques, and priorities. Two short breaks will be provided.


  • What is disparate treatment on the basis of sex and why is it prohibited?
    • Examples and forms of disparate treatment
  • What is disparate impact, how does it differ from disparate treatment, and how should it be addressed and remedied?
  • How should disparate treatment complaints be analyzed?
  • How do the 2020 Title IX regulations encompass disparate treatment?
  • How and when can disparate treatment complaints be addressed outside of the 2020 Title IX regulations but still within a Title IX framework?
  • What are the best practices for processing a disparate treatment complaint?
    • Who is the respondent?
    • Who is the complainant?
    • What is the range of remedies, and how are they timed when inequity is systemic and cannot be reversed overnight?
    • Can a university host single-sex programs?
      • Exceptions recognized by the regulations?
      • Are separate but equal programs permissible?
    • Can single-sex programs be hosted at a university if they are not a university program?
      • Camps, women’s leadership events, and STEM feeder programs
    • How to frame/advertise programs to target participants of a particular sex, but allow all comers?
    • How to lay a foundation for the need for affirmative action to correct a historical imbalance, inequity, or barrier to access?
    • What to do if someone complains to OCR that a single-sex program at your campus is causing disparate treatment?
    • Are single-sex scholarships legal?
    • How does a college audit its scholarships to make sure they are available equitably based on sex?
    • If there are problematic single-sex scholarships, how should they be addressed?
