The Outliers: Behaviors Prohibited by Title IX that are not Violence or Harassment

Not all behaviors prohibited by Title IX fall into the categories of violence or harassment. As a sex equality law, Title IX prohibits discrimination generally. The Investigating Sex Discrimination and Disparate Treatment Workshop builds upon the information provided in ATIXA’s Title IX Coordinator Foundations Level 2: Sex Discrimination in Higher Education course and provides practitioners with an opportunity to sharpen skills for investigating discrimination complaints that are commonly termed “disparate treatment” by the courts. Such complaints often involve investigating the impact of climate/culture, policies, and practices. These types of investigations require different skills and methodologies from harassment investigations and are predicated on different policies.

ATIXA’s expert faculty members will guide participants through ATIXA’s disparate treatment construct, sharing practical knowledge and tips to prepare participants to investigate complex complaints. This workshop will examine elements of an effective investigation, including the core elements of intake, investigation, evidence gathering, and evidentiary analysis, all through the unique lens of disparate treatment allegations. Faculty will also briefly review the related topic of disparate impact.

ATIXA recommends that participants complete the Title IX Coordinator Foundations Level 2: Sex Discrimination in Higher Education course and the Investigation Foundations course or have pre-existing knowledge of the topics covered in those courses prior to enrolling in this workshop.

Examine the elements of an effective equity investigation, including the core elements of gender equity, collective/joint complaints, collecting relevant evidence, and analyzing disparate treatment and intent.
