Identifying the correct policy violations to charge is a critical step in the Title IX resolution process. How allegations are framed can determine the scope of an investigation, the questions that are asked, the issues presented to decision-makers, and whether the parties understand what is being alleged. Charges that are overly broad, unnecessarily narrow, duplicative, or disconnected from institutional policy can create confusion and undermine an otherwise sound resolution process.
This four-hour Best Practice Workshop gives Title IX practitioners a practical framework for developing clear, accurate, and defensible charging practices. Participants will learn how to take reported conduct and identify specific policy provisions that should be charged, distinguish between factual allegations and implicated policies, and determine the appropriate level of specificity needed when drafting charges and notices.
Through discussion and applied examples, participants will examine challenging charging scenarios, including overlapping allegations, patterns, incidents involving multiple parties or forms of prohibited conduct, and situations where charges evolve during the course of the investigation. The workshop will also address common pitfalls such as overcharging, undercharging, duplicative charges, and the risks of allowing investigative terminology to replace careful policy analysis.
Participants will leave with strategies for developing consistent charging practices that support fair notice, thorough investigations, sound decision-making, and reliable outcomes throughout the Title IX resolution process.
