Question:
Does peer retaliation apply only to students? Who are “peers” within the regs?
Answer:
The 2024 Title IX regulations define “peer retaliation” in § 106.2 as “retaliation by a student against another student.” Retaliation by an employee against another employee is not included in this definition because such conduct is covered under the definition of “retaliation” and prohibited by § 106.71, as well as under Title VII. 89 FR 33833.
