The Title IX regulations, at 34 C.F.R. § 106.45(b)(7)(iii), state: “The recipient must provide the written determination to the parties simultaneously.” The regulations do not further define “simultaneous,” which should be given its plain and ordinary meaning, e.g., occurring at the same time.
